Tijdelijk besluit digitale toegankelijkheid

The Netherlands has implemented accessibility requirements through the "Tijdelijk besluit digitale toegankelijkheid" (Temporary Decree on Digital Accessibility) and subsequent legislation implementing the European Accessibility Act.

This applies to both public sector websites (which have been required to be accessible since 2018) and now private sector digital services under the EAA.

Scope in the Netherlands

Dutch businesses must comply if they provide:

  • E-commerce services (webshops)
  • Banking and financial services
  • Transport services (OV-chipkaart, NS, etc.)
  • Telecommunications services
  • Audiovisual media services (streaming platforms)

Dutch enforcement authorities

Autoriteit Consument & Markt (ACM)

The ACM is responsible for market surveillance and can impose fines on businesses that fail to meet accessibility requirements for consumer-facing services.

Sector-specific regulators

Depending on the industry, other regulators may be involved. For example, DNB for banking services and the Autoriteit Financiële Markten (AFM) for financial services.

What Dutch websites must meet

WCAG 2.1 Level AA

The technical standard referenced by Dutch accessibility legislation is WCAG 2.1 Level AA (aligned with EN 301 549). This includes requirements for:

  • • Perceivable content (text alternatives, captions, contrast)
  • • Operable interface (keyboard access, no seizure triggers)
  • • Understandable information (readable, predictable)
  • • Robust technology (compatible with assistive technology)
