EAA in the Netherlands
European Accessibility Act compliance for Dutch businesses
The Netherlands has implemented the EAA through national legislation. Dutch businesses must ensure their digital services meet accessibility requirements.
Dutch Implementation
How the Netherlands implemented the EAA
Tijdelijk besluit digitale toegankelijkheid
The Netherlands has implemented accessibility requirements through the "Tijdelijk besluit digitale toegankelijkheid" (Temporary Decree on Digital Accessibility) and subsequent legislation implementing the European Accessibility Act.
This applies to both public sector websites (which have been required to be accessible since 2018) and now private sector digital services under the EAA.
Scope in the Netherlands
Dutch businesses must comply if they provide:
- E-commerce services (webshops)
- Banking and financial services
- Transport services (OV-chipkaart, NS, etc.)
- Telecommunications services
- Audiovisual media services (streaming platforms)
Enforcement
Dutch enforcement authorities
Autoriteit Consument & Markt (ACM)
The ACM is responsible for market surveillance and can impose fines on businesses that fail to meet accessibility requirements for consumer-facing services.
Sector-specific regulators
Depending on the industry, other regulators may be involved. For example, DNB for banking services and the Autoriteit Financiële Markten (AFM) for financial services.
Penalties for non-compliance
The Netherlands takes accessibility seriously. Non-compliant businesses face:
Fines
Administrative fines based on violation severity and company size
Orders
Mandatory compliance orders with deadlines
Public naming
Publication of non-compliant businesses
